Please read these Terms and Conditions carefully before using the Flowwasp website, platform, applications, and related services (collectively, the “Service”). By accessing or using the Service, you agree to these Terms and to our Privacy Policy, as updated from time to time.

1. Acceptance of Terms

These Terms and Conditions form a binding agreement between you and Flowwasp, operated by Waspnote (“Flowwasp,” “Waspnote,” “we,” “us,” or “our”).

If you do not agree to these Terms, you must not create an account, access the Service, or make any purchase.

Additional policies, order pages, product pages, checkout notices, refund notices, and service-specific terms may apply to certain features and are incorporated by reference where posted.

2. Eligibility and Legal Capacity

You may use the Service only if you can form a legally binding contract under the laws that apply to you.

We do not impose a minimum age restriction; however, if the laws of your jurisdiction require parental consent, guardian consent, or any other authorization for certain users, you are responsible for meeting those requirements.

By using the Service, you represent that your use is lawful in your location and that you have authority to agree to these Terms.

3. Account Registration and Security

To create an account, you must provide your name, email address, and password.

You may also sign in using Google login, where available. If you use Google login, you authorize us to receive account information made available through that login method in accordance with your settings and the applicable provider terms.

You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.

You must notify us promptly if you suspect unauthorized access to your account or any security breach.

4. Communications and Email Preferences

By creating an account or using the Service, you consent to receive service-related emails such as account notices, billing messages, security alerts, transaction confirmations, password resets, and support communications.

You may opt in to receive marketing or promotional emails where offered, and you may unsubscribe from promotional emails at any time using the unsubscribe link or by contacting support.

Even if you opt out of promotional messages, we may still send you non-marketing messages related to your account, purchases, security, legal notices, or service operations.

5. Description of the Service

Flowwasp provides software-as-a-service offerings that may be sold on a subscription basis, a one-time payment basis, or both, depending on the plan or product you choose.

We may update, improve, suspend, or discontinue features at any time, subject to applicable law and any express commitments made on the applicable order page or plan description.

We may set usage limits, fair-use limits, feature restrictions, or plan-specific conditions for different offerings.

We do not serve third-party advertisements on the Service.

6. Plans, Pricing, Billing, and Taxes

Prices, billing intervals, plan features, and renewal terms are shown at checkout or on the relevant plan page.

For subscription products, charges may recur at the interval stated at purchase until the subscription is canceled or ends under these Terms.

For one-time purchases, the applicable fee is due at the time of purchase unless we state otherwise.

All fees may be shown in the currency indicated at checkout. You are responsible for any taxes, levies, duties, bank charges, chargeback fees, or similar amounts imposed by your bank, card issuer, payment provider, or local authorities, unless we state otherwise.

7. Payments and Third-Party Processors

Payments are processed through third-party payment providers, including Razorpay, and may also be subject to the payment provider’s own terms, rules, and risk controls.

You authorize us and our payment processors to charge your selected payment method for all amounts due, including recurring subscription charges where applicable.

We do not store or control all payment data handled by payment processors. Their collection and use of payment information are governed by their own privacy and security practices.

If a payment is declined, reversed, charged back, or flagged as unauthorized, we may suspend or limit access to the Service until the matter is resolved.

8. Merchant Name and Billing Descriptor

The registered business entity operating and managing Flowwasp is Waspnote.

Depending on the payment method and processor used, charges, receipts, statements, checkout references, or billing descriptors may appear under the name “Waspnote.”

By completing a purchase, you acknowledge and agree that Waspnote may appear as the merchant, recipient, or billing descriptor for Flowwasp transactions.

Billing inquiries, refunds, chargebacks, and payment-related support for Flowwasp services will be handled by Waspnote on behalf of Flowwasp.

9. Refunds, Cancellations, and Chargebacks

Refund requests are handled on a case-by-case basis and are not automatic.

To request a refund, you should contact us with your order details, the reason for the request, and any supporting information we reasonably ask for.

We may consider factors such as the plan purchased, whether the Service has been used, the nature of the issue reported, timing of the request, and any applicable legal or processor requirements.

Subscription cancellations stop future billing, but cancellation does not automatically entitle you to a refund unless we approve one or applicable law requires one.

For one-time purchases, any refund decision will also be handled case by case unless a mandatory legal right applies.

Nothing in these Terms limits non-waivable refund rights that may apply under mandatory law.

10. Acceptable Use

You agree not to misuse the Service or help anyone else do so.

Prohibited conduct includes, without limitation: violating applicable law; attempting unauthorized access; interfering with or disrupting the Service; copying, scraping, reverse engineering, or tampering with the Service except to the extent such restrictions are not permitted by law; uploading malicious code; impersonating others; and using the Service for fraud, spam, or abuse.

We may suspend or terminate accounts that we reasonably believe are involved in prohibited conduct.

11. Customer Data and Content

You retain ownership of content, data, files, and materials that you upload, submit, or process through the Service, to the extent you have such rights.

You grant us a non-exclusive, worldwide, royalty-free license to host, process, transmit, reproduce, and display your content only as needed to operate, improve, secure, and support the Service, comply with law, or as otherwise permitted by you.

You are responsible for ensuring that your content and data do not infringe third-party rights or violate any law.

12. Analytics, Cookies, and Tracking Technologies

We use analytics and tracking technologies, including Google Analytics and Meta Pixel, to measure usage, improve performance, understand user behavior, and evaluate marketing or conversion performance where applicable.

These technologies may use cookies, pixels, tags, and similar tools. You can manage some cookie and tracking choices through your browser or device settings and through any site controls we make available.

Where required by law, we will ask for your consent before placing non-essential cookies or enabling similar tracking technologies.

13. Third-Party Services

The Service may integrate with or link to third-party services, including Google, Razorpay, and other tools or platforms we may use from time to time.

We are not responsible for third-party websites, services, policies, outages, or acts, and your use of those services may be governed by separate terms.

Your continued use of any integrated feature may require you to accept the relevant third-party terms.

14. Intellectual Property

The Service, including its software, interface, design, branding, trademarks, logos, and content provided by us, is owned by or licensed to us and is protected by applicable intellectual property laws.

Except for the limited right to access and use the Service under these Terms, no ownership rights are transferred to you.

You may not use our name, logos, or branding without our prior written consent, except as expressly allowed by law or by a separate written agreement.

15. Suspension and Termination

We may suspend or terminate your access to the Service, remove content, or disable accounts at any time if we reasonably believe you have violated these Terms, created risk or legal exposure for us or others, or used the Service in a way that is unlawful or harmful.

You may stop using the Service at any time, and where available you may cancel your subscription through the account or billing settings.

Sections that by their nature should survive termination, including payment obligations, intellectual property, disclaimers, limitations of liability, indemnity, and dispute provisions, will survive.

16. Disclaimers

To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis.

We do not guarantee that the Service will be uninterrupted, error-free, secure, or compatible with every device, browser, network, or third-party service.

We do not make warranties that the Service will meet every user’s expectations or business goals.

17. Limitation of Liability

To the maximum extent permitted by law, Flowwasp and Waspnote will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, or reputational harm arising out of or relating to the Service or these Terms.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid to Flowwasp for the Service giving rise to the claim during the twelve months before the event giving rise to the claim, or the minimum amount permitted by law, whichever is greater.

Some jurisdictions do not allow certain limitations, so some of the above limits may not apply to you.

18. Indemnity

You agree to defend, indemnify, and hold harmless Flowwasp, Waspnote, their directors, officers, employees, contractors, and affiliates from and against claims, losses, liabilities, damages, costs, and expenses arising out of or related to your use of the Service, your content, your violation of these Terms, or your violation of any law or third-party right.

19. Governing Law and Dispute Resolution

These Terms are governed by the laws of India, without regard to conflict-of-law rules, except where mandatory local consumer, tax, payment, or data-protection laws require otherwise.

Subject to any mandatory legal rights you may have, you agree to first try to resolve any dispute by contacting us in good faith before starting formal proceedings.

If a particular clause is unenforceable in your jurisdiction, it will be read to the minimum extent necessary so the rest of the Terms remain effective.

20. Changes to These Terms

We may update these Terms from time to time.

When we do, we will post the updated version on the Service and change the “Last Updated” date above, unless a different notice method is required by law.

Your continued use of the Service after the updated Terms become effective means you accept the updated Terms.
